Terms of Service

By accessing or using BePulse AI you confirm that you are at least 16 years old, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy. If you are using BePulse AI on behalf of a business, you represent that you have authority to bind that business to these Terms.

We may update these Terms from time to time. Continued use of the service after updates constitutes acceptance of the revised Terms. We will notify users of material changes by email.

BePulse AI is a SaaS analytics and intelligence platform for small businesses. The service connects to your business platforms (including Instagram and Shopify), aggregates your data, and provides AI-powered insights, weekly revenue plans, and a conversational AI assistant.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

You must create an account to use BePulse AI. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete registration information.
• Update your information promptly if it changes.
• Notify us immediately at contact@bepulse.ai if you suspect unauthorized access to your account.
• Not share your account credentials with any third party.

We reserve the right to terminate accounts that are found to be in violation of these Terms.

BePulse AI is offered on a subscription basis. Current pricing is $60 per month for the founding member tier. Founding member pricing is subject to change with 30 days written notice to the email address on your account.

• Billing. Subscriptions are billed monthly in advance. Payments are processed by Stripe. By subscribing you authorize us to charge your payment method on a recurring monthly basis.
• Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
• Failed payments. If a payment fails, we will attempt to retry for up to 7 days. If payment is not resolved, your account may be suspended until the balance is cleared.
• Price changes. We reserve the right to change pricing for new and existing subscribers with 30 days written notice.
• Taxes. Prices are exclusive of applicable taxes. You are responsible for any taxes applicable to your subscription.

You agree not to use BePulse AI to:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights, privacy rights, or other rights of any third party.
• Transmit harmful, offensive, defamatory, or fraudulent content through the platform.
• Attempt to gain unauthorized access to any part of the service or its infrastructure.
• Use automated means (bots, scrapers) to access the service in a way that exceeds normal usage or places unreasonable load on our systems.
• Resell or sublicense access to BePulse AI without our written consent.
• Use the service to process data on behalf of third parties as a data processor or bureau without a separate data processing agreement.

We reserve the right to suspend or terminate accounts that violate these restrictions without notice.

BePulse AI connects to third-party platforms including Instagram (Meta), Shopify, Anthropic, Zapier, and others. Your use of those platforms is governed by their respective terms of service. We are not responsible for the availability, accuracy, or actions of any third-party platform.

By connecting a third-party account you grant BePulse AI permission to access and display your data from that platform as described in our Privacy Policy. You may revoke access at any time through the Connections page or directly within the third-party platform.

All content, design, software, trademarks, and branding comprising BePulse AI — including but not limited to the name “BePulse AI,” the Electric Green color system, and all AI-generated outputs produced by our system — are the property of Beunorthodox Branding or its licensors and are protected by applicable intellectual property laws.

You retain full ownership of your business data (revenue figures, follower counts, order data, etc.) that you connect to BePulse AI. You grant us a limited, non-exclusive license to process and display that data solely to provide the service to you.

AI-generated insights, plans, and recommendations are provided for informational purposes. You may use them freely for your business but may not resell or redistribute them as your own product.

BePulse AI is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, Beunorthodox Branding disclaims all implied warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content is not financial, legal, or professional advice. Decisions made based on BePulse AI insights are made at your own risk.

To the maximum extent permitted by applicable law, Beunorthodox Branding and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, loss of data, or loss of business opportunity — arising out of or related to your use of BePulse AI, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to us in the 12 months prior to the claim or (b) $60 USD.

Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. We may terminate or suspend your account immediately if we determine, in our sole discretion, that you have violated these Terms.

Upon termination, your right to access the service ceases immediately. We will delete your data in accordance with our Privacy Policy. Sections 7 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), and 11 (Governing Law) survive termination.

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, and you consent to exclusive jurisdiction in such venue.
